U2, Jimmy Bufffett involved in lawsuits
Probably the least likely names to share a news headline, ultra-activists U2 and the one-hit wonder that doesn't give up, Jimmy Bufffet, have found some common ground over an issue they feel very strongly about: merchandise and memorabilia. More specifically, they both are seeking to control the use of their likenesses on unauthorized merchandise by way of lawsuits.
U2's case against Lola Cashman, a former stylist for the band, was decided in their favor early Wednesday. Cashman claims that the band gave her several items of memorabilia. The band said she stole them. Among the items were a Stetson hat, earrings, and clothing worn by Bono during U2's Joshua Tree tour in 1987. This latest decision puts an end to a protracted legal process, one that began when Cashman tried to auction off the memorabilia in 2002. U2 is not asking Cashman to pay for the court costs, though they do expect to get all the items returned. Jimmy Buffett is fighting to take down a website that claims to be an official Jimmy Buffett Margaritiaville Online Store for Merchandise. The website is not, however, affiliated with Buffett in any way and now the novelty tune pop star wants it shut down for unlawfully using his trademark to sell merchandise. The site in question isi http://www.underonehut.com, which is owned by a man named Robert Akard. Buffett's biggest problem with the site, however, isn't that he is selling the merchandise without authorization but that he is selling it at marked up prices. "The markup on items is as high as 50%" according to Buffett lawuyer Anthony Buzbee. This isn't the first time that Buffett has tried to shut down Akard, having earler had a website called parrotsofthecaribbean.com taken offline.
